Governor Ducey Adot Ease Burden On Commercial Drivers

On Dec. 9, 2021, Governor Doug Ducey announced a series of actions that ADOT is taking to safely ease the process for obtaining a Commercial Driver License in an effort to alleviate stress on the transportation system and help address the nationwide supply chain crisis. These actions include:

To facilitate more commercial drivers being able to obtain credentials, through Executive Order, the Governor will extend the validity of the commercial learners permit from six months to one year for those that expire between Dec. 1, 2021 and Feb. 28, 2022, in alignment with federal law. This gives a student more time to fulfill training requirements without having to reapply for a new permit. The purpose of the CLP is to allow a student to operate a commercial motor vehicle for training purposes with a licensed driver present.

The Medical Review Program helps ensure that CDL drivers meet Federal Regulation 49 CFR 391.41 Physical Qualifications for Drivers and CFR 391.43.

Starting May 21, 2014, all commercial motor vehicle drivers must have a physical performed by a medical examiner listed on the National Registry of Certified Medical Examiners.

Note that the process for application is the same in every state: whether renewing, applying for or changing your DOT card, youll first select which type of commercial operation you will be performing with your license, then you will be asked to submit yourself for a new DOT physical exam. A DOT physical exam has many different components. Here are the six things to expect during a DOT physical.1

Whether you are renewing or acquiring a new card, during a DOT physical, the driver will need to provide extensive background on their medical history, including past surgeries, medications taken, and history of health conditions. Nonetheless, it is always important to be honest when providing health history as there could be repercussions later on if the correct health history is not provided.

Have it in mind that a large portion of the DOT physical is testing vitals. Testing includes pulse, height, weight, and blood pressure. The FMCSA also requires urinalysis, which looks at the protein, blood, and sugar in a urine sample to rule out underlying medical problems.

Coupled with the other general testing above, the FMSCA requires vision testing to ensure drivers are meeting the standard of at least 20/40 vision acuity in each eye with or without correction and at least 70° field of vision in horizontal meridian measured in each eye .

Determining Your Type Of Self

Do you have a Montana Interstate commercial driver license or an Intrastate commercial driver license?

If you have a Montana Intrastate commercial driver license, under Montana state law your only option is to self-certify as Intrastate Non-Excepted.

If you have a Montana Interstate commercial driver license you have two options:

Option 1: You may self-certify as Interstate Non-Excepted .

Option 2: You may self-certify as Interstate Excepted IF you drive a CMV exclusively in one of the following activities:

If you believe you qualify for excepted status, check with your employer before self-certifying as excepted. Some employers still require their drivers to be medically qualified and self-certify as non-excepted.

Who Needs A Medical Card

In general, you need a DOT medical card if you’re a commercial driver who drives from one state to another, which is referred to as interstate driving. If you only drive within your state and dont pass through another state at any point, you’re considered an intrastate driver and you typically dont need a medical card.

Your states licensing agency will require you to certify which type of driving you do. Not all interstate drivers are required to get a medical card, though. Some of the exceptions include:

• Drivers who are government employees.
• Fire truck or rescue vehicle drivers.
• Those transporting school children between home and school.
• Those driving farm equipment.

If you’re uncertain whether you need a medical card or a medical card renewal, contact your state licensing agency. States also have their own medical requirements, so you may need a medical exam even if you’re just driving within your state, but you won’t typically need a DOT medical exam.

Commercial Drivers License holders are now able to renew their licenses online if they are self-certified in the Non-Excepted Interstate category for medical certification.

What Will Happen If You Let Your Dot Medical Card Expire

Even though some of the rules tend to vary by state of licensure, all interstate commercial drivers license holders are expected to provide a current copy of their Medical Examiners Certificate to their states drivers licensing agency.

Note that this process known as medical card self-certification, is a very crucial step in ensuring that drivers meet the physical requirements of the Federal Motor Carrier Safety Regulations issued by the Federal Motor Carrier Safety Administration .

Getting and renewing your DOT Card may seem involved when you let it expire, so it should be done on time at avoid consequences. The exact consequences of letting your DOT Card expire vary by state.

Normally, some states will suspend your commercial driving privileges. Some states suspend your privileges immediately, while others give you a grace period to renew your certificate.

In some states, if you take too long to renew your DOT card, you may have to go through the entire testing process for a CDL again. For instance, in Indiana, if your DOT card expires for more than one year, you must retest. In Kansas, you must retest if it is expired for more than 90 days.

The Baker-Polito Administration issued a list of designated businesses and other organizations that provide essential services and workforces related to COVID-19 that shall continue to operate brick and mortar facilities during this period. This list is based on federal guidance and amended to reflect the needs of Massachusetts unique economy. While these businesses are designated as essential, they are urged to follow social distancing protocols for workers in accordance with guidance from the Department of Public Health.

Typically, states dont have an expired DOT medical card fine. If the certificate expires, though, you may have to retest or reinstate your license and there may be costs involved in that process.

Once you pass your medical exam and file it with the state, you should keep the original copy with you for at least 10 days whenever you drive. After that, youre not required to carry your certificate, but you may want to do so just to be on the safe side. If you took a special skills assessment to obtain your certificate, you do need to keep that with you any time you drive.

REGARDING Expiring Drivers Licenses and medical examiners certificates during COVID-19 National Emergency

The President has declared a national emergency under 42 U.S.C. § 5191 related to Coronavirus Disease 2019 . This Notice is in response to COVID-19 outbreaks and their effects on people and the immediate risk they present to public health, safety, and welfare in the fifty States and the District of Columbia. Many States are experiencing greater than normal employee absences or have closed offices of their State Driver Licensing Agencies in response to the guidance from the U.S. Center for Disease Control to use social distancing to reduce the spread of COVID-19. Because of these actions, many commercial motor vehicle drivers are unable to renew their drivers license and are unable to provide medical certificates to their State Driver Licensing Agencies.

This Notice of Enforcement Policy, effective from March 24, 2020 to June 30, 2020, provides needed relief from specified FMCSRs for CLP holders, CDL holders, and non-CDL driversand motor carriers using those drivers. This Notice of Enforcement Policy applies to all CLP holders, CDL holders, and non-CDL drivers whose license was issued for less than the maximum period established by 49 CFR 383.25 and 383.73 and was valid on February 29, 2020 and expired on or after March 1, 2020.

Cdl Medical Card Waivers Extended Through February 2021

The Federal Motor Carrier Safety Administration has extended the waivers for renewals of interstate and intrastate commercial drivers licenses , commercial learners permits and medical cards to Feb. 28, 2021.

Drivers with CDLs, CLPs or medical cards who were granted a waiver from renewal deadlines in 2020 must renew and have them in place for commercial vehicle operations beginning March 1, 2021.

Due to the COVID-19 pandemic and the closure of many state licensing offices and medical facilities, FMCSA gave relief on March 24, 2020 to professional drivers whose CDLs, permits and/or medical cards had expired or were set to expire after March 1, 2020.

The waiver extended renewal deadlines for those credentials to June 30. FMCSA already extended these waivers twice, with the most recent extension for CDLs and permits ending Dec. 31. The medical certificate extensions ended either Oct. 31 or Dec. 31, depending upon the medical cards original date of expiration.

FMCSA has continued relief from specific hours of service regulations through Feb. 28, 2021 for the transportation of COVID-19 relief supplies, adding vaccines, their components and supplies to the list of COVID relief commodities. Now FMCSA has set the same date of Feb. 28, 2021 for compliance with licensing and medical certificate renewals.

Owners of heavy commercial vehicles will have to renew their vehicle validations by December 31, 2021. Those who hold novice licences class G1, G2, M1, or M2 have until December 31, 2022 to re-qualify, or to upgrade the novice licence. The regular expiry dates for G1 and G2 licences will resume on January 1, 2023.

Eligible accessible parking permits with expiry dates between March 17, 2020 and February 28, 2022 must be renewed before March 1, 2022.

Vehicle Safety Standard Certificates, temporary registrations, and special permits with expiration dates between March 1, 2020 and September 1, 2021, will be valid until October 6, 2021.
